New Legal System

I think most of the government that we have should be removed or at least vastly simplified. All of it should be disposed of, except for a small piece of the judicial system. The process for random selection of a jury should remain, but everything else should go. All the law making bodies and policy making bodies should be eliminated. All the federal regulators, administrations and agencies should be removed. This sounds insane and drastic, but look at the next paragraph for the legal system and you will see that almost none of these agencies are necessary. People will either take care of themselves and (to a lesser extent, where it suits their own interests) each other, or they will be weeded out by natural forces.

As far as laws and the legal system go, I believe there should be only four laws, and therefore four crimes. The four crimes would be:

A term used several times there was citizen. A citizen is the standard unit of society. They are free (they own themselves), can own property, can move freely within the borders of the nation and can be called upon to act as jury members in legal disputes. A non-citizen has no rights, is not protected by the law and cannot own property. A slave is the property of another citizen. Slaves can be for life or for a set period of time. The only way to become a slave is to either commit a crime or if you are a non-citizen, to be claimed by a citizen as found property. When a citizen becomes a slave, all of their property is declared forfeit and is distributed at the discretion of the jury that ruled over the case, any leftover wealth is given to support the state. Property would often go to the victim, the perpetrators family, or it may be given as a loan to someone who has just recently emerged from slavery in an effort to get them back onto their feet and able to contribute to society as a citizen again.

Lawyers would still hold an influential place in society, as any set of laws is subject to interpretation. The word "willful" is open to debate as to whether the defendant intended to kill or hurt the victim. The judge and jury would be combined into a single judicial body. For each legal dispute, a council of 12 citizens, randomly selected, is called to be arbitrate the dispute, judge the evidence presented by both sides, and finally, give ruling and punishment. For cases of murder, the court would first try to find another country that would be willing to take in a convicted murderer, in which case the citizen is stripped of their citizenship and deported to this country. If no country can be found that will accept them, they are put to death. Either way, the victim's must be compensated, either by the criminal's property or life.

There would be laws governing the treatment of slaves. You can do anything you want to your slaves, treat them however you wish, but any physical harm you do to them must be healed within a year after their release, or you count as having commited Assault and can be punished for that crime. This is to prevent people from killing, paralyzing, blinding, maiming or in other ways permanently harming their slaves. Scars don't sount as permanent damage, only things that would prevent them from living the way they did when they became slaves.
